Counsel for Applicant :- Ardhendu Shekhar Sharma,Ram Babu Sharma Counsel for Opposite Party :- Arvind Kumar Singh,G.A. Hon'ble Dr. Gautam Chowdhary,J.
Learned counsel for the applicant submits that against the summoning order, the applicant filed a Criminal Misc. (482) Application No. 10136 of 2015 (Rakesh and another Vs. State of U.P. and another), in which interim protection was granted to the applicant. He further submits that by the efflux of time, the said application was dismissed vide order dated 12.08.2024 on the ground that it has become infructuous in the absence of the counsel for the applicant. Learned counsel next argued that thereafter, the applicant filed instant anticipatory bail application in which interim anticipatory bail has been granted by this Court vide order dated 22.01.2025, in the meantime, the aforesaid criminal misc. (482) application was restored to its original number vide order dated 05.04.2025 and the interim order has been revived. Learned counsel further argued that since the interim order passed in the 482 Cr.P.C. application has been revived, thus there is no apprehension of arrest of the applicant and therefore the instant anticipatory bail application has become infructuous and prays that the same may be disposed of as withdrawn. In view of above, the instant application is disposed of.
