This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 75 and 78 of B.N.S. Act and Section 66(E) of I.T. Act. 3. The allegation in the F.I.R. is that prior to the date of occurrence Arti Devi i.e. the petitioner had taken the mobile phone of the prosecutrix and talk with one Dhiraj Paswan, thereafter a dispute arose between the prosecutrix and Arti Devi and Arti Devi threatened the prosecutrix to teach her a lesson. Dhiraj Paswan later called the prosecutrix from his mobile and wanted to talk with Arti Devi. The prosecutrix replied that she is not maintaining any relation with this petitioner and requested Dhiraj Paswan not to call her again, but after some time again Dhiraj Paswan called the prosecutrix and they became good friends and started taking with each other. It is alleged that Dhiraj Paswan used to talk in vulgar language with the informant. Dhiraj Paswan blackmailed the informant and forced her to send naked photos of her. The informant stated that she fell pray to said blackmail and send her naked photo to Dhiraj Paswan. It is further alleged that Dhiraj Paswan asked for more physical benefits to which she refused. The informant further alleges that Dhiraj Paswan has send the video of the informant to the petitioner and this petitioner had circulated the said photographs. 2025:JHHC:13810 4. From the F.I.R., I find that the only allegation against the petitioner, who is lady, is that Dhiraj Paswan has forwarded some of the photographs of the informant to her which she had circulated. 5. From the case-diary, it is clear that some of the witnesses have stated that this petitioner had circulated the obscene photographs / video of the informant and they have seen it. Except their statement there is nothing in the case-diary which has been produced before me. 6. Since the petitioner is a lady and the main allegation is against Dhiraj Paswan, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of her surrender or arrest, she shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-cum- Special Judge, Cyber Crime at Giridih, in connection with Birni P.S. Case No.03 of 2025, subject to the condition that she has to appear before the Investigating Officer once in ten days and co-operate with the investigation till the final report is submitted and further subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
