Goswami, learned Additional Public Prosecutor for the State respondent No. 1 and Mr. M. K. Das, learned counsel appearing on behalf of the respondent No. 2. This is an application under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail to the accused/ petitioner, who has been arrested in connection with Gauripur P.S. Case No. 89/2025, under Sections 137(2)/115(2)/64(2)(k)/ 351(2)/3(5) of BNS, 2023 read with Section 6 of POCSO Act. The case was fixed today for production of the Case Diary; however, Mr. Goswami, learned Additional Public Prosecutor, has submitted that the I.O. has already laid charge-sheet, vide Charge-Sheet No. 121/2025, dated 18.04.2025. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been charge-sheet, vide Charge- Sheet No. 121/2025, dated 18.04.2025, the accused/petitioner is hereby Page No.# 3/3 directed to approach the learned Trail Court with an appropriate application for bail, which shall be considered in accordance with law.
