Heard the counsel for the applicant. The present contempt application has been filed pleading willful disobedience of the order dated 19.10.2020 passed by this Court in Writ - A No. 7562 of 2020. The Standing Counsel has filed a compliance affidavit disclosing that the husband of the applicant was under the CPF Scheme and the contribution of the State had to be deposited by the concerned Degree College where the husband of the applicant was engaged. It has been stated in the affidavit that the applicant has already been paid family pension in accordance with the Government Orders dated 2.7.1984 and 5.7.2018 for a period of ten years. The counsel for the applicant contends that the husband of the applicant was not under the CPF Scheme and was entitled to pension. The aforesaid contention is an issue on merit and is regarding the substantive rights of the applicant and her husband and is not to be decided under the Contempt of Courts Act, 1971. The applicant has the remedy to raise her grievance before the appropriate forum. The application is disposed of and consigned to records. Notice issued to the opposite party is discharged.
