A RAVI SHANlofRTAdvocate for the Petitioner and of PUBLIC PROSECUTOR for the Respondent; The Court made the following : THE HON'BLE SRI JUSTICE KI SREENIVASA REDDY !±!mjnal Petition No.2571 o±J2Q2§ Order: This Criminal Petition, under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner herein/A12, seeking anticipatory bail, in connection with crl-me No.572 of 2024 of Kasibugga Poll-ce Station, Srikakulam district. 2. A case has been registered against the petitioner herein and others for the offences punishable under sections 25 and 27 of the Arms Act and Sections 109(1), 61(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, I-n brI-ef, iS that On 20.12.2024 between 05.30 pm and 08.30 pm at the house of Badda Nagaraju of chI-nnabadam village, Palasa Mandal, the petitioner conspired with other accused in this crime and engaged Bihar gang for killing one Badda Nagaraju, and the Investigating officer arrested Al to A4 and A6 and their confession revealed that the petI'tiOner also conspired to kl'll said Badda NagaraJ-u by contributl'ng amount and that police regl-stered a case against the petitioner and other accused. €=- ls={9 `- -------- -f1 2 I/ 4. Heard. perusedtherecord. 5. Basing on the confessional statement of co-accused, name of the petitioner has been shown as accused in the Present crime. Except the confessional statement, there is no other material to connect the petitioner with the crime. lt is stated that about five persons apart from the petitioner were Present along with co-accused who are from Bl-har State. Except the tower location, there is no other materI'al tO COnneCt the petitioner with the crime. At thI'S Stage, without there being any corroboration for the aforesaI-d meetI-ng, jt cannot be said that the petitI|Oner was in hand-in-glove with other accused. 6. Learned Assistant public prosecutor subm,Its that as per the confessI'Onal statement of co-accused, it is the petitI-Oner herein who negotiated with the co-accused from Bihar and he is the person who handed over cash of Rs.10,00,000/-to other persons, and hence, if the petitioner I'S granted anticipatory bail, there Its every chance that he may hamper with investigatI-On. Even accepting the said accusation to be true, the entl're case is based on the confessional statement of co-accused. Basing on the confessional statement of co-accused, the petitioner cannot be subjected to custodial interrogation at this stage. €`ra `_`s 7. ln view of the 'afOreSaid facts and Circumstances Of the case, this court is inclined to grant anticipatory bail to the petitioner herein/A12 on the following conditions. i) ln the event of arrest of the petitioner herein/A12 in the aforesaid crime, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the Satisfaction Of the concerned Arresting Officer. ii) petitioner shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat Or Promise tO any person acquainted with the facts of the case so as to dissuade him from d|lsclosing such facts to the Court or tO any police officer. iii) petitioner shall appear before the Station House Officer concerned once in a week i.e., on every sunday between 10.00 AM and 1.00 PM till filing of the charge sheet. 8.
