Neutral Citation No. - 2025:AHC:110676 Court No. - 70 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 10316 of 2024 Applicant :- Akeel And Another Opposite Party :- State of U.P. and Another Counsel for Applicant :- Puneet Srivastava Counsel for Opposite Party :- G.A. Hon'ble Dr. Gautam Chowdhary,J.
1. Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record. 2. The present application has been moved seeking anticipatory bail in Case Crime no. 14 of 2023, under Section 3/7 of Essential Commodities Act, Police Station Barla, District Aligarh, with the prayer that in the event of arrest, applicant may be released on anticipatory bail. 3. It has been argued by the learned counsel for the applicants that applicants are innocent and they have an apprehension that they may be arrested in the above-mentioned case, whereas there is no credible evidence against them. He further submitted that the applicant is the owner, whereas the applicant no.2 is the driver of vehicle and the alleged recovery is false and fabricated. It was also submitted that applicants undertakes to co-operate during investigation and trial and they would appear as and when required by the investigating agency or Court. It has been stated that in case, the applicants are granted anticipatory bail, they shall not misuse the liberty of bail and will co-operate with the investigation and would obey all conditions of bail. 4. Learned A.G.A.has opposed the application for anticipatory bail
and argued that charge sheet has been submitted upon which cognizance has also been taken against the applicants, therefore is credible evidence against the applicants, thus the applicants are not entitled for bail. 5.
Another Bench of this Court vide order dated 03.12.2024 had granted interim anticipatory bail to the applicant subject to the conditions contained in that order, in which one of the condition was to the effect that the effect that the applicants shall appear before the trial Court on each date fixed unless personal presence is exempted and perusal of the order sheets of the case, copy of which is annexed as Annexurfe-SA1 to the supplementary affidavit, shows that the applicants are not appearing before the trial Court rather bailable warrants and non-bailable-warrants have been issued against the applicant no.1 and another applicant is seeking adjournments, which itself shows the conduct of the applicants that they are lingering on the process of trial, thus this Court is of the opinion that the applicants are not entitled for anticipatory bail. 6. Accordingly, it is dismissed. 7. Interim order, if any, stands vacated. 8. Office is directed to communicate the order passed by this Court to the concerned Court below forthwith.
