The petitioner has been made accused in connection with S.T. On 30.08.2019, Officer In-charge of Balumath Police Station on the basis of confidential information that extremists belonging to T.S.P.C Cadre had gathered in Balumath forest. On the basis of this information police party reached the place of occurrence and arrested co-accused Jivlal Ganjhu. From whose possession, firearm and naxal pamphlets were recovered.
Learned counsel for the petitioner submitted that though petitioner is named in the F.I.R., but his name has come in confession of co-accused Jivlal Ganjhu. It was further submitted that similarly situated several co-accused persons have been granted by this Court as well as by Co-ordinate Bench of this Court. Learned Spl.P.P. has opposed the prayer for bail. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Latehar, in connection with S.T.
