THE PROJECT DIRECTOR DWMA, KADAPA YSR KADAPA DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or direction more particulars in the nature of writ of mandamus declaring the action of the respondents in continuing the petitioner as APO on out sourcing basis and paying the meagre salary of Rs 13,000/- and not continuing the petitioner as APO on contract basis and not paying 2 regular salary of Rs 28,000/- though the charges levelled against the petitioner are found to be false and dropped vide RC No. 2997/Sidhiout Manda1/10 SA/2016 dt -07-2017 as illegal, arbitrary, discriminatory, highhanded, violation of principles of natural justice and cannot be justified in the eye of law and consequently direct the respondents to continue the petitioner as APO on contract basis and pay the salary attached to the said post with all consequential benefits including the monitory benefits in the interest of justice and pass such other order or orders. GP FOR PANCHAYAT RAJ RURAL DEV (AP) The Court made the following: ORDER: Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondents 2 to 4 would submit that no further orders are required in this matter in the light of the proceedings issued by the respondent authorities vide Rc.No.HR/APOs- Reinstatement/2017, dated 28.08.2018, by dropping the termination order and issued proceedings to continue the petitioner under fixed tenure employee. 2. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 3 3. For ready reference, the relevant portion in the written instructions is extracted hereunder: “......in accordance with the Rule 6.3 and 6.5 of Rule 6 of disciplinary rules for FTEs of SRDS (2012) communicated in through ref.6th cited, Smt.B.Sailaja, APO, Kamalapuram who was working as APO (FTE) and removed from duties vide ref. 1st cited, and subsequently reinstated to duties as APO (Outsource) vide ref. 3rd cited in accordance with the orders contained in ref. 2nd cited of Member Secretary, SRDS, AP, Vijayawada, is reinstated to duties as APO on FTE basis w.e.f. 5.5.2017 i.e., from the date of joining as APO, Kamalapuram as APO (outsource), since all the allegations levelled against her were dropped vide this office ref. 8th cited.” 4. In the light of the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
