The petitioner claims that he is entitled to arrear of third time scale as well as arrear of 6th Pay Commission alongwith interest. A representation in this regard has been made but to no avail. Learned counsel for the respondents submits that the matter requires factual determination as per applicable law by the competent authority in the first instance. He however fairly submits that the claim of the petitioner needs to be decided in an expeditious time frame. In the wake of submissions made by the parties, and without going into the merits of the case, interest of justice will be served by directing the respondent no. 3, Executive Engineer, Purvanchal Vidyut Vitran Nigam Ltd. to execute the following directions: I. The respondent no. 3, Executive Engineer, Purvanchal Vidyut Vitran Nigam Ltd. shall decide the representation of the petitioner for arrear of third time scale as well as arrear of 6th Pay Commission alongwith interest within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
