1. Principal Secretary, Department of General Administration, Secretariat, Jaipur.
2. Manager, Circuit House, Ajmer. ----Respondents For Petitioner(s) : Mr. M.K. Dhakad for Mr. R.A. Katta For Respondent(s) : Ms. Manju Joshi, AGC with Ms. Deepa Singh HON'BLE MR. JUSTICE SUDESH BANSAL
Order 10/07/2025
1. In the instant writ petition, petitioner has raised a grievance for not according promotion to him on the post of House Keeper w.e.f. 1987.
2. Counsel for respondents has placed on record the order dated 28.03.2023 (Annexure-M/A/1) along with the application (1/2023), stating inter alia, that against the vacancies of House Keeper, which arose in the year 2014-15 on 01.06.2014, petitioner has been accorded promotion on such post. Another order dated 02.05.2023 (Annexure-M/A/2) has also been placed on record showing that against the vacancies for the year 2022-23, petitioner has been further promoted from the post of House
[2025:RJ-JP:25446] (2 of 3) [CW-9968/2006] Keeper to Assistant Manager in the pay matrix Level-9 w.e.f. 01.04.2022 and petitioner has joined in pursuance thereof.
3. Counsel for petitioner sought to place reliance on an order dated 07.08.2006 (Annuexure-20) whereby and whereunder another employee namely Shri Govind Singh Rathore was appointed on the post of House Keeper w.e.f. 01.11.1986, hence, petitioner is claiming parity to grant him promotion w.e.f. year
1987.
4. However, perusal of the order dated 07.08.2006 clearly shows that such order was passed under directions of judgment dated 18.11.2005 passed in S.B. Civil Writ Petition No. 4805/2002.
5. Counsel for respondents submits that indeed petitioner did not acquire the requisite qualification and maturity for promotion, hence, cannot claim equality/ parity with Govind Singh Rathore. Counsel further submits that since petitioner has been given promotion to the post of House Keeper and was further promoted to the post of Assistant Manager. Such orders have been accepted by the petitioner and he has joined on the promotional post, hence, in that view, the grievance of petitioner does not survive any more.
6. In view of the afore-referred facts, since the petitioner has already been accorded promotion on the post of House Keeper and further on the post of Assistant Manager, the grievance stands satisfied, however, in case petitioner claims promotion from back date, he is at liberty to file fresh writ petition with better particulars.

8. Stay application and other pending application(s), if any, also stand disposed of.
