The petitioner has challenged the order dated 23.04.2024 passed by the respondent no.2-Prescribed Authority, under Payment of Gratuity Act 1972/Assistant Labour Commissioner, Firozabad. 2. A preliminary objection has been raised by Sri Rajesh Tewari, learned counsel for the respondent that against the aforesaid order statutory alternative remedy is available to the petitioner to file an appeal as provided under sub-Section (7) of Section 7 Payment of Gratuity Act, 1972. 3. It is also admitted by counsel for the petitioner. 4. In this view of the matter, present writ petition is dismissed on the ground of availability of statutory alternative remedy available to the petitioner under sub-Section (7) of Section 7 Payment of Gratuity Act, 1972.
