The present writ petition has been filed by the petitioner praying for following reliefs:- (i) Issue a writ, order or direction in the nature of certiorari quashing the impugned recovery certificate dated 13.12.2022 issued by the respondent no.4 as well as order dated 04.09.2023 passed by respondent no.2 (Annexure No.1 and 2 to this writ petition). (ii) Issue a writ order or direction in the nature of mandamus commanding directing the respondent authorities to not take any coercive action during the pendency of the recall application dated 08.01.2024 on the basis of the application dated 12.07.2023 of the respondent no.5." Learned counsel for the petitioner submits that a direction be issued to the respondent authorities to decide the recall application dated 8.1.2024 within a stipulated period. Learned Standing Counsel submits that the recall application dated 8.1.2024 will be decided by respondent authorities in a time bound manner. In view of the aforesaid, this writ petition is disposed of directing the respondent authorities to consider and decide the recall application dated 8.1.2024 as expeditiously as possible, preferably, within a period of one month from the date of production of a certified copy of this order without giving unnecessary adjournment to either of the parties.
