Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Gandey P.S. Case No. 86 of 2023 registered under Sections 302/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner has committed murder of his wife Sabita Devi. It is then submitted that the allegations against the petitioner are all false and in para 56 of the case diary, it has been mentioned that the police is investigating the case to collect evidence regarding the offence punishable under Section 306 of IPC and there is no materials in the record to show that there is homicidal death of the deceased.
