Present appeal has been filed against the judgement and order dated 29.6.2005 passed by Additional Sessions Judge, Fast Track Court, Shahjahanpur in Session Trial No. 1770 of 2003, in Case Crime No. 135 of 2002, under Section 452/302 I.P.C. P.S. Jaitipur, District Shahjahanpur. Further prayer has been made to release the appellant in the aforementioned case during pendency of the present appeal. 3. As per office report dated 22.3.2025 based on the report of learned Chief Judicial Magistrate, Shahjahanpur dated 4.11.2023, appellant Nanhey has died about six years ago. Along with report, statement of Mahesh S/O Jagdish his nephew, Bahadur S/O Makulal, brother of appellant, Liladhar, Gram Pradhan, Man Singh, Sub-inspector have also been placed on record. Apart from this, certificate of Shamshan Ghat Swarg Ashram, Village Krawan Nagar, Delhi dated 12.1.2018 has also been placed on record. 4. Accordingly, appeal stands abated. 5. However, the record of present appeal shall remain connected with the connected appeal No. 2714 of 2005.
