Sri Satish Kumar Mishra, Advocate has put in appearance on behalf of petitioner in this writ petition. 2. This writ petition is pending since 1999 i.e. about 2- 1/2 decades. The petitioner has approached this Court with following prayer :- “i. issue a writ, order or direction in the nature of mandamus directing the Respondents to pay the salary of petitioner on the post of Assistant L.T. Grade Teacher on the basis of short term vacancy till regular selection not made by commission or till not joined the post held by the petitioner. ii. issue a writ, order or direction in the nature of mandamus commanding the Respondents to pay the salary to the petitioner on basis of approval given by District Inspector of Schools, dated 12.9.97. iii. issue a writ, order or direction in the nature of mandamus commanding the Respondents to pay the salary to the petitioner regularly.” 3. This Court was gracious to pass an interim order on 15.06.1999 whereby interim mandamus was issued to respondent-1 to pay salary to petitioner within a period of 3 months from the date of production of certificate and a liberty was granted to respondents to file counter affidavit, however, till date no counter affidavit has been filed, therefore, there is no objection on behalf of respondents. 4. In aforesaid circumstances, Court also takes note that petitioner may be aged about 59-60 years and it appears that he has taken advantage of interim order since there is no subsequent pleading that interim order was not followed. 5. Accordingly, interim order dated 15.06.1999, as referred above, is made absolute and this writ petition is disposed of. Order Date :- 28.2.2025 Sinha_N.
