The petitioners namely, (i) Sri Hiranya KR. Patgiri (ii) Sri Dilip Kalita (iii) Sri Dipak Mili have filed this application under Section 483 of the BNSS, 2023 with prayer for bail as they are behind bars since 22.03.2025 in connection with Panigaon Police Station Case No. 15/2025 under Sections 308(2) and 61(2) of the BNS, 2023. 3. Heard Mr. R. J. Baruah, learned Additional Public Prosecutor, Assam for the respondent State. 4. The allegation against the petitioners is that being police officers, they have demanded money from the poor cattle owner, i.e., the informant of this case. 5. Learned Additional Public Prosecutor has raised serious objection stating that there are incriminating materials in the case-diary against the petitioners. 6. I have scrutinized the case-diary. Indeed there are incriminating materials in the case-diary against the petitioners. Case-diary reveals that the petitioners have co-operated with the investigation. It appears that bail may be granted to the petitioners. 7. Considering all aspects, petition is allowed. The petitioners shall be enlarged on bail on furnishing a bail bond of Rs. 30,000/- each with a suitable surety of like amount to the satisfaction of the learned CJM, Lakhimpur, North Lakhimpur under the condition that: Page No.# 3/3 (i) The petitioners shall refrain from such activities with which they are alleged. 8. On breach of any of the bail conditions, the Court is at liberty to immediately cancel the bail granted to the petitioners. 9.
