The present application u/s 482 Cr.P.C. has been filed with prayer to quash the order dated 13.09.2024 passed by the Additional Chief Judicial Magistrate, Aligarh, in Criminal Case No. 205 of 2010 (State v. Subhash and others) arising out of Case Crime No. 11A of 1997, under Sections 147, 148, 149, 307, 325, 504, 323, 427 of IPC, P.S. Gonda, District Aligarh, whereby the application has been dismissed. Learned counsel for the applicants fairly admits that that the question involved in the present application has already been decided by a co-ordinate Bench of this Court in Application u/s 482 No. 6259 of 1999, vide order dated 30.08.2010. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application u/s 482 Cr.P.C. is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
