THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2853 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in Crime No.806 of 2023 of Patamata Police Station, Vijayawada City, NTR District, registered for the alleged offence under Section 337 of the Indian Penal Code, 1860 (hereinafter referred to as ‘I.P.C.’). 3. The learned counsel further submits that the petitioner was working as a driver in R.T.C. and that on 19.08.2023, while he was driving the bus, a two-wheeler rider hit the bus from behind, which resulted in fatal injuries to one of the motorcyclist and two others were travelling along with the deceased on the motorcycle received minor injuries. The police have registered a case in crime No.806 of 2023 initially under Section 337 IPC; subsequently, the provision of law was altered to 304-A and 337 of I.P.C. 4. The learned counsel further submits that the petitioner's driving license was seized by the police and that they have not conducted an investigation in spite of more than one and half year. Thelearned counsel further submits that unless and until the driving licence is released, the petitioner would not eke out his livelihood. 5. Considering the submissions, the petitioner shall make an application to the Station House Officer, Patamata Police Station, Vijayawada City, seeking the release of his driving licence, which was seized in connection with Crime No.806 of 2023. Upon receiving the application, the Station House Officer shall release the driving licence of the petitioner. 6. With the above observation, the criminal petition is disposed off. 7.
