Applicant-Arjun Prasad has filed this petition under Section 407 Code of Criminal Procedure for transfer of Criminal Case No. 141603 of 2022; titled State vs. Arjun and others, arising out of Case Crime No. 0104 of 2022, under Sections 419, 420, 467, 468, 471, 120B IPC and Section 6/10 U.P. Public Examination Act, 1998, registered at Police Station Babupurva, District South (Commissionerate Kanpur Nagar) pending before Metropolitan Magistrate-9, Kanpur Nagar to any other court of competent jurisdiction at Ballia. Learned counsel for the applicant-accused prays for transfer of the criminal trial from Kanpur Nagar to Ballia on the ground that his mother being a Cancer patient is under treatment, and the applicant is also preparing for competitive examinations, therefore, it is difficult for him to defend the case at Kanpur Nagar. He prays for transfer of the trial from Kanpur Nagar to Ballia. Concededly, the applicant was extended the concession of regular bail in the year 2022 and the two co-accused of the applicant have not been impleaded in this application. That apart, the grounds raised by the applicant are not sufficient for transfer of the case. The application is dismissed.
