This criminal appeal filed by the appellant-accused under Section 374(2) of Cr.P.C. is directed against the impugned judgment of conviction and order of sentence dated 29.01.2007, passed by the learned 3rd Additional Sessions Judge (FTC), Surajpur, District - Surguja (C.G.) in Sessions Trial No. 522/2004, whereby the appellant-accused has Digitally signed by HEERA LAL SAHU Date: 2025.01.06 18:18:11 +0530 2 been convicted for offence under Section 489(c) of IPC and sentenced to undergo R.I. for 3 years with fine of Rs.500/- with default stipulation. 2. In this case, pursuant to the order of this Court dated 14.11.2024 a bailable warrant was issued against the appellant which returned unserved. A report from the office of Station House officer, Police Station – Jhilmili, District- Surajpur (C.G.) has been received, according to which the sole appellant-Narendra Kumar Tiwari S/o Mahendra Tiwari of this case died on 08.10.2015, a death certificate of the appellant has been attached with the report to this effect. 3. In view of the matter, this Criminal Appeal stands disposed of as the legal representative of the appellant has not approached to contest the appeal.
