The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 by the applicants to quash the entire proceedings of Criminal Case No.101 of 2025, “State vs. Sandeep Singh and Another”, pending before the court of Chief Judicial Magistrate, Udham Singh Nagar. 2. Subsequent to the submission of the charge- sheet, the learned Magistrate took cognizance and passed the summoning order against the applicant- Sandeep Singh under Sections 323, 377, 498A and Section 504 of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961 and 1
2025:UHC:7596 against the applicant no.2-Smt. Manjeet Kaur, under Section 3 and Section 4 of the Dowry Prohibition Act,
1961. 3. Heard Mr. Basant Singh, learned counsel for the applicants, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mr. Ankush Singhal, learned counsel for the respondent no.2/informant. 4. Applicant No.1 Sandeep Singh is the husband of the informant and Manjeet Kaur, the applicant no.2, is the mother of the applicant no.1. 5. Both the applicants are present in-person. They are identified by Mr. Basant Singh, Advocate. Respondent no.2-informant is present in-person. She is identified by Mr. Ankush Singhal, Advocate. 6. Both, the applicants and the respondent no.2 submitted that they have settled their matrimonial disputes and reached to a compromise pursuant to which, they have filed a Compounding Application (IA No.01 of 2025) with their affidavits. 7. The applicants and the respondent no.2 further submitted that they have filed compounding application and affidavits with their free will and 2
2025:UHC:7596 without any pressure. Respondent no.2 has requested to quash the entire proceedings of Criminal Case No.101 of 2025. 8. Mr. Pradeep Lohani, Brief Holder submitted that the applicants and the respondent no.2 have settled their matrimonial disputes amicably, therefore, the State has no objection to the submission of the respondent no.2. 9.
Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.101 of 2025, “State vs. Sandeep Singh and Another”, pending before the court of Chief Judicial Magistrate, Udham Singh Nagar, are quashed. 10. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No.101 of 2025, “State vs. Sandeep Singh and Another”, pending before the court of Chief Judicial Magistrate, Udham Singh Nagar, are hereby quashed. ___________________ Date: 27.08.2025 ALOK KUMAR VERMA, J.
