1. Impugned in this petition is an interim order dated 19.08.2025, passed by the Central Administrative Tribunal, Srinagar Bench [“ the Tribunal”] in OA No. 887/2025 titled “Abdul Shakoor Bhat Vs. Sher-i- Kashmir University of Agricultural Sciences and Technology & Ors.” ,whereby the Tribunal has directed the respondents to file reply as well as the status report explaining as to whether the order has been passed by the competent authority and also directed the petitioners herein not to relieve the respondent herein till the next date of hearing. 2. Impugned order is challenged by the petitioner-University on the ground that same is not only non-speaking but was passed without affording a reasonable opportunity of hearing to the petitioner who was duly represented before the Tribunal through counsel.
3. Having heard learned counsel for the parties and perused the impugned order, we find that the interim order impugned does not find mention of any of the
submissions made by Mr. S.M. Ayoub, learned counsel appearing for the petitioner-University.
4. The order also sans reasons for showing indulgence in staying the transfer. The impugned interim order is therefore patently in violation of principles of natural justice, and, therefore, cannot sustain.
5. This petition is accordingly allowed and order impugned dated 19.08.2025, passed by the Tribunal is set aside.
6. The Tribunal shall consider the prayer of the respondent for interim relief afresh after providing reasonable opportunity of hearing to the petitioner-University.
7. The OA which is pending consideration before the Tribunal is preponed and shall be taken up for considering the interim relief on 18.02.2026.
8. Disposed of.
