Applicant has filed this application under Section 407 of Criminal Procedure Code seeking transfer of Session Trial No.6234 of 2024, titled State vs. Yunus and others, arising out of case crime no.0629 of 2020, under Sections 498A, 323, 504, 506, 307 IPC and U/s 3/4 of Dowry Prohibition Act and U/s 3/4 Muslim Women (Protection of Right on Marriage) Act, Police Station Lisadi Gate, District Meerut, pending in the court of Additional District Judge V, Meerut to the competent court of jurisdiction at district Ghaziabad, Hapur or NOIDA. None for the applicant. Applicant- husband is accused in Sessions Trial No.6234 of 2024 arising out of case crime no.0629 of 2020 along with two other co- accused persons who is seeking transfer of the trial from Meerut to Ghaziabad on the ground that whenever he appeared before the trial court, the complainant- wife is threatening him. As per the averements on 4th September, 2024, when he along with his family members went to the court of Additional Sessions Judge, Meerut, the opposite party no.2, her mother and other ladies abused him and asked for Rs.20,00,000/- for settlement. Upon considering the averements contained in the application, this Court does not find any merit as on 4th September, 2024, the wife of the applicant- opposite party no.2 failed to appear before the trial court, whereupon the bailable warrants were issued against her. The allegations of threatening etc. are not supported with any material, therefore, this Court is not inclined to transfer the trial to Ghaziabad. This application is dismissed.
