WP No. 36326 of 2025 2.Mr.P.Harish, learned Government Advocate, takes notice on behalf of the 1 st respondent. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself. 3.Learned counsel for the petitioner would submit that the petitioner filed a suit in O.S.No.4 of 2018 before the Additional District Munsif Court, Thittagudi, Cuddalore District for permanent injunction against the 2 nd respondent and the suit was decreed on 07.12.2020, thereby the petitioner presented the application before the 1 st respondent for registration of decree on 03.05.2022 in O.S.No.4 of 2018. However, the 1 st respondent did not register the same and further the petitioner made a representation on 05.08.2025 in this regard and so far, no action has been taken to register the decree. WP No. 36326 of 2025 4.Learned Government Advocate appearing for the 1 st respondent would submit that the petitioner has not presented the decree before the 1 st respondent for registration till date. If the decree is presented for registration, the same will be considered by the 1 st respondent.
5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the 1 st respondent. 6.Considering the submissions made by the learned counsel for the petitioner and the learned Government Advocate appearing for the 1 st respondent and in view of the limited prayer sought for in this Writ Petition, without going into the merits of the case, this Court directs the petitioner to present the decree passed in O.S.No.4 of 2018 for registration before the 1 st respondent as per the procedure laid down in the Registration Act, 1908. If any such decree is presented by the petitioner, the 1 st respondent is directed to register the same in terms of Section 18 of the Registration Act, 1908. https://www.mhc.tn.gov.in/judis
