Applicant-Ranu Pandey has filed this petition under Section 407 Code of Criminal Procedure for transfer of Case No. 4164 of 2019; titled Ranu Pandey vs. Akhilesh Pandey and others, under Section 12 Protection of Women from Domestic Violence Act, 2005, registered at Police Station Cantt., District Varanasi pending before Judicial Magistrate-III, Varanasi to any other court of competent jurisdiction at Allahabad. Concededly, the subject case was filed by the wife at Varanasi, when she was residing there, and transfer is being sought on the ground that now she has started residing at Prayagraj with her widowed mother. The sole ground raised for transfer of the case is not sufficient, as the two towns are at a short distance, which are conveniently connected. The application is dismissed.
