The present Application has been filed under Section 528 of the Bharatiya Nagarik Suraksh Sanhita, 2023 by the applicant to quash the entire proceedings of Criminal Case No.283 of 2025, “State vs. Saurav Joshi”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar. 2. Subsequent to the submission of the charge- sheet, the learned Magistrate took cognizance and passed the summoning order against the applicant under Sections 323, 498A, 504, 506 of the Indian Penal 1 2025:UHC:7494 Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 3. Heard Mr. Abhishek Verma, learned counsel for the applicant, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mr. Arjun Arora, learned counsel for the respondent no.2/informant- victim. 4. Saurav Joshi, the applicant and the husband of the respondent no.2, is present in-person. He is identified by Mr. Abhishek Verma, Advocate. Smt. Bhawna Joshi, the respondent no.2/informant-victim, is present in-person. She is identified by Mr. Arjun Arora, Advocate. 5. Both, the applicant and the respondent no.2 submitted that they have settled their matrimonial disputes and reached to a compromise pursuant to which, they have filed a Compounding Application (IA No.01 of 2025) and affidavits. 6. The applicant and the respondent no.2 further submitted that they have filed compounding application and affidavits with their free will and without any pressure. Smt. Bhawna Joshi, the 2 2025:UHC:7494 respondent no.2, has requested to quash the entire proceedings of Criminal Case No.283 of 2025. 7. Mr. Pradeep Lohani, Brief Holder submitted that there were matrimonial disputes and the applicant and the respondent no.2 have settled their disputes, therefore, the State has no objection to the Compounding Application (IA No.1 of 2025). 8. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.283 of 2025, “State vs. Saurav Joshi”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, are quashed. 9. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No.283 of 2025, “State vs. Saurav Joshi”, pending before the court of Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 25.08.2025 ALOK KUMAR VERMA, J.
