HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION Present: THE HON’BLE JUSTICE JAY SENGUPTA WPA 3958 of 2025 Sk. Mohibulla & another Versus The State of West Bengal & Ors. For the petitioners : Mr. Mohinoor Rahaman Mr. Imdadul Biswas Ms. Iqra Rahaman For the State Mr. Amitava Chaudhuri Mr. Pradipta Siddharta For the respondent no.4 Mrs. Tapati Samanta Mr. Arindam Ghosh Heard on : 26.02.2025 Judgment on : 26.02.2025 JAY SENGUPTA, J: Learned counsel appearing on behalf of the petitioners submits as follows. The petitioner applied for selection in the post of Librarian under 2 the OBC-A category. He faired well in the examination. However, when the panel came out, he found that his name was placed under the Waiting List Serial No. 2. He got 66.75 marks. But, he believes that he must have done better than the others. Learned counsel appearing on behalf of the respondent no.4 denies the allegations and submits that there is no scope of re-appreciation of answer scripts. If anyone resigns after joining the posts, the names of the waitlisted candidates could be considered subject to the provisions applicable. However, the merit list has been prepared according to the marks obtained. It does not appear that the petitioner has come up with a particular reason as to why the marks allotted to the candidates should be questioned. There is a merit list published and the petitioner features as Serial No.2 in the waiting list under the OBC-A category. This Court cannot encourage roving and fishing enquiries on the basis of vague and unsubstantiated allegations. Therefore, I do not find any reason to intervene in the matter. Accordingly, the writ petition is dismissed. However, there shall be no order as to costs. As affidavits were not called for, the allegations made in the writ petition are deemed not to have been admitted. 3 Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
