Neutral Citation No. - 2025:AHC:32603 Court No. - 32 Case :- WRIT - C No. - 6154 of 2021 Petitioner :- Uma Shankar Singh And 23 Others Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Hritudhwaj Pratap Sahi,Sankalp Narain Counsel for Respondent :- Arvind Srivastava,C.S.C.,Tapan Kumar Mishra,Vikash Chandra Tiwari Hon'ble Saral Srivastava,J.
1. List has been revised. Learned counsel for the private respondents is not present.
2. Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
3. The petitioners by means of the present writ petition have assailed the order dated 24.12.2020 passed by the Regional Level Committee, Vindhyachal Mandal, Mirzapur whereby the Regional Level Committee approved the election of respondent no.7 and rejected the claim of the petitioners.
4. In the instant case, from the order of Regional Level Committee, it appears that the petitioners did not file objection against the election of respondent no.7. The two persons whose objection has been noted by the Regional Level Committee are C.B.I. and Alok Kumar Bhatiya and they have not approached this Court.
5. The petitioners claimed to be the life member of the Society namely 'Obra Shiksha Samiti Obra, Mirzapur'. Since the petitioners did not raise any objection against the election of respondent no.7 before the Regional Level Committee, therefore, the petition on behalf of the petitioners challenging the impugned
order, is not maintainable.
6. It is further contended by learned counsel for the petitioners that a direction be issued to the Assistant Registrar to consider the claim of membership of petitioners.
7. Since the aforesaid issue is not before the Court and this Court has held that the petition on behalf of petitioners challenging the
order dated 24.12.2020 is not maintainable, therefore, in such view
of the fact, no direction can be issued by this Court to the Deputy Registrar/Assistant Registrar for considering the membership issue of the petitioners in the present petition.
8. Accordingly, writ petition is dismissed with no order as to cost.
