The present Application has been filed by the applicant- Sacchidanand Awasthi for anticipatory bail in Case Crime No.47 of 2024, registered at Police Station Dharasu, District Uttarkashi. 2. The First Anticipatory Bail Application (ABA No.909 of 2025) was dismissed as withdrawn on 13.08.2025 granting liberty to the applicant to file afresh anticipatory bail application. 3. Heard Mr. Niranjan Bhatt, learned counsel for the applicant and Mr. Chitrarth Kandpal, learned Brief Holder for the respondent. 4. According to the First Information Report 1 2025:UHC:7447 dated 28.10.2024, Brahamadev Nidhi Ltd. Company induced the villagers on the pretext of giving them adequate interest, to open accounts in the company and asked them to deposit money daily. The informant deposited his money, but, now, the company is refusing to refund his matured amount. 5. Mr. Niranjan Bhatt, Advocate, contended that the investigation is being conducted for the offence under Section 420 of the Indian Penal Code, 1860, Sections 3 read with Section 21(1)(2)(3) of the Banning of Unregulated Deposit Schemes Act, 2019 and Section 3 of the Uttarakhand Protection of Interest of Depositors (In Financial Establishments) Act, 2005. Dimpal Ramola is one of the founder member of the said company. She engaged the applicant to collect the money from the depositors for the said company. Applicant collected the money and whole of the collected money was handed over to her. Dimple Ramola has been granted anticipatory bail by learned Special Judge/Ist Additional Sessions Judge, Dehradun on 10.07.2025. Applicant is a permanent resident of District Uttarkashi, therefore, there is no possibility of his absconding, and, he has no criminal antecedents. 6. Mr. Chitrarth Kandpal, learned Brief Holder, 2 2025:UHC:7447 on instruction, has opposed the anticipatory bail application orally. 7. Having heard the submissions of learned counsel for the parties and keeping in view of the facts and circumstances of the case, without commenting on the merits of the case, the present Application, filed for anticipatory bail, is allowed. It is directed that in the event of arrest of the applicant Sacchidanand Awasthi, he shall be released on anticipatory bail on executing a personal bond of Rs. 30,000/- and two reliable sureties, each of the like amount, to the satisfaction of the Arresting Officer, subject to the following conditions:- (i) Applicant shall cooperate with the Investigating Agency and he shall make himself available for interrogation by a police officer as and when required; (ii) If the charge-sheet is filed, the applicant shall attend the trial court regularly and he shall not seek any unnecessary adjournment; (iii) Applicant shall not directly or indirectly make any inducement, threat or promise to any person, acquainted with the facts of this case; (iv) Applicant shall not leave the country without the previous permission of the trial court. 8.
