Heard Mr. S.P. Das, learned counsel appearing for the petitioner. Also heard Mr. K. Bhattacharjee, learned counsel appearing for the respondent No. 1. This Interlocutory Application is filed under Section 5 of the Limitation Act for condoning the delay of 150 days in filing the connected Criminal Revision Petition. Mr. S.P. Das has submitted that the delay occurred in filing the connected Criminal Revision Petition was caused by genuine reasons and he has explained
Page No.# 3/3 the said delay in Paragraph 7 of the said affidavit wherein it is stated in the said Paragraph under reply that the petitioner was suffering from illness and was under treatment of the doctor for a long period of time and that after he recovered, he came down to Guwahati to engage an advocate and the delay of 150 days was caused due to the same. This Court on looking into the grounds of delay is satisfied with the reasoning’s given therein. Mr. K. Bhattacharjee also fairly submits that he has no objection for condoning the delay as the reasons for the same was found to be genuine. In view of the same, this Court finds it fit that the delay of 150 days in filing the connected Criminal Revision Petition may be condoned for the interest of justice. The I.A. is disposed of.
The connected Criminal Revision Petition may be registered by the Registry and be listed for admission. JUDGE Comparing Assistant
