Mr. Alok Kumar, learned counsel for the petitioners. 2. Mr. Suyash Pant, learned Standing Counsel for the State of Uttarakhand. 3. Mr. Lalit Miglani, learned counsel for respondent no. 3. 4. Petitioners are resident of Ward No. 3 of Salimpur, Bhumiya Khera, Rajputan, Roorkee, District Haridwar. They are aggrieved by the construction of underground drain. According to them, Nagar Nigam Roorkee, is proposing to construct drain on both sides of the lane on which house of the petitioners is situate and petitioners apprehend that the ramp, which connect their houses to the lane, would be demolished in the process of construction of drain. 5. Learned counsel appearing for the Nagar Nigam, however, submits that writ petition is without any cause of action. The construction of drain has not begin, as yet. 6. This Court finds substance in the submission made by learned counsel for Nagar Nigam Roorkee, however, having regard to the apprehension expressed by petitioners, they are permitted to make representation to the Municipal Commissioner. If they make representation within one week from today, Municipal Commissioner shall 2025:UHC:7503 look into the matter and take appropriate decision, as per law, within three weeks thereafter.
