The petitioners through instant petition filed under Article 226/227 of the Constitution of India are seeking or direction specially in the nature of prohibition restraining the respondents from placing stones in the Satluj River
As per petition, the petitioners are resident Said Mohammad and Paraliwala, faction and to save one or two villages from flood of Satluj villages of District Moga are being put to trouble. In & 2025, there was flood in various villages of District Moga from Satluj River. A huge crop land was damaged. 40 villages of Sultanpur Lodhi area and more than 70 villages of Shahkot area were affected by floods. Despite said order, the respondents are placing stones so that flow of river water may be stopped and if this water of the river can be diverted towards the land of petitioners and th fertile land would be flooded by rapid flow of water. Their crop be destroyed. The petitioners have served representations followed by legal notice upon respondents, but to no avail. Act of respondents amounts to violation of Sections 327 & 328
Learned counsel on being pointed out that the petitioners have already approached the Civil Court and there is an interim order in their favour expressed his inability to dispute that as per Order 39 Rule 2A of CPC, the petitioners have effec owever, he submits that the respondents may use force and implicate the petitioners in some criminal case.
The matter is indubitably pending before the Civil Court and there is an interim order in favour of the petitione reason to invoke the writ jurisdiction.
Accordingly, the petition stands dismissed petitioners to avail alternative remedy. 20.04.2026
