Serial No. 18 Regular HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR Bail App 4/2025 CrlM(23/2025) Nisar Ahmad Wani. …Petitioner(s) Through: Mr. Arfat Rashid, Adv. VERSUS UT Th. ACB Baramulla. …Respondent(s) Through: None. CORAM: HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE. ORDER 31.10.2025 1. Reply to the bail application stands filed by the respondent Investigating Agency. As per the reply, investigation of the case is in progress and during the course of investigation, it has been established that the petitioner had demanded and accepted Rs. 4000/- as illegal gratification from the complainant in lieu of providing copy of NOC of Fire and Emergency Services Department, which was required by the complainant for opening of timber sale depot at Janbazpora, Baramulla. It has been further submitted that the petitioner has abused his official position by his aforesaid action. It is pleaded that there are genuine apprehensions that, in case the petitioner is enlarged on bail, he may influence the witnesses. 2. From a perusal of the reply filed by the respondent Investigating Agency, it appears that the custodial interrogation of the petitioner is no more required by the respondent investigating agency. The trap money has already been recovered from his possession and it is not the case of respondents that any further recovery has to be effected from him. The petitioner has been on interim bail since 14-01-2025. The respondent Investigating Agency has not placed on record any fact that would go on to show that the petitioner has violated any of the conditions of bail. 3. In view of the above, the interim bail granted to the petitioner on 14-01-2025 is made absolute subject to the conditions laid down in the said order. 4. Petition stands disposed of.
