This Application has been filed under Section 528 of the Bharatiya Nagarik Suraksh Sanhita, 2023 to quash the entire proceedings of Criminal Case No.158 of 2024, “State vs. Raje Singh and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh. 2. Subsequent to the submission of the charge- sheet, the learned Magistrate took cognizance and passed the summoning order against the applicants under Sections 323, 498A, 504, 506 of the Indian Penal 1 2025:UHC:7497 Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act, 1961. 3. Heard Mr. Aman Mudgal, learned counsel for the applicants, Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1 and Mr. Sumit Joshi, learned counsel for the respondent no.2/informant-victim. 4. Both, the applicant Raje Singh, the husband of the respondent no.2 and the applicant no.2, the mother of the applicant no.1, are present in-person. They are identified by Mr. Aman Mudgal, Advocate. 5. The respondent no.2 Smt. Megha Bisht, the informant – victim, is present in-person. She is identified by Mr. Sumit Joshi, Advocate. 6. Both, the applicants and the respondent no.2 submitted that they have settled their matrimonial disputes and reached to a compromise pursuant to which, they have filed a Compounding Application (IA No.01 of 2025) and affidavits. 7. The applicants and the respondent no.2 further submitted that they have filed the compounding application and affidavits with their free will and without any pressure. Smt. Megha Bisht, the 2 2025:UHC:7497 respondent no.2, has requested to quash the entire proceedings of Criminal Case No.158 of 2024. 8. Mr. Pradeep Lohani, Brief Holder submitted that there were matrimonial disputes and the applicants and the respondent no.2 have settled their disputes, therefore, the State has no objection to the Compounding Application (IA No.1 of 2025). 9. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.158 of 2024, “State vs. Raje Singh and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, are quashed. 10. Resultantly, the present Application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and the entire proceedings of Criminal Case No.158 of 2024, “State vs. Raje Singh and Another”, pending before the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 25.08.2025 ALOK KUMAR VERMA, J.
