By means of the present writ petition, the petitioner has sought the following relief:- “i. Issue a writ, order or direction in the nature of mandamus, commanding/directing the respondent no.3 to lodge an F.I.R. against the respondent nos.3, 4 & 5 on the complaints of the petitioner dated 04.09.2021 & 06.09.2021 (Annexure No.8 to the writ petition) in view of the judgment passed by Hon’ble Apex Court in the light of ‘Lalita Kumari’ case as well as in the light of judgment passed by this Hon’ble Court in ‘Ashish Bhargawa’ case under the relevant sections of I.P.C. and D.P. Act in accordance with law.” 4. It is contended by learned counsel for the petitioner that the writ petition has been filed for a direction to respondent no.2-S.H.O. Kotwali Ramnagar, District Nainital to register F.I.R. against respondent nos.3, 4 and 5. 5. This Court vide order dated 25.03.2025 directed learned State counsel to seek status report with regard to prayer of the writ petition for lodging of the F.I.R. against respondent nos.3, 4 and 5. 6. Today, on instructions, which are made part of the record, it is submitted by learned State counsel that after preliminary enquiry no offence has been made out against respondent nos.3, 4 and 5. 7. In view of aforesaid instructions, submitted by learned State counsel, nothing remains to be decided in the writ petition. 8. Accordingly the writ petition is dismissed.
