Order 29/04/2025
1. The present bail application has been filed by the accused- applicant under Section 483 of the B.N.S.S, 2023 against the
order dated 11.02.2025 passed by learned Additional Sessions Judge No.3, Alwar in connection with FIR No.991/2024 registered at Police Station Kotwali Alwar, District Alwar for the offences punishable under Sections 310(2) & 331(6) of BNS, 2023 (later on Section 61(2) of BNS), by which the bail application of the accused-applicant under Section 483 of BNSS, 2023 has been dismissed.
2.
Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter and the allegation against the accused-applicant is that she sent the photographs of the house to the co-accused-Aryan on WhatsApp
[2025:RJ-JP:17983] (2 of 3) [CRLMB-3420/2025] in which the dacoity was committed. Learned counsel argues that the accused-applicant has not been alleged to commit robbery/dacoity and no recovery has been made from her.
Learned counsel also argues that charge-sheet has been filed and no other criminal case is registered against the accused- applicant. Learned counsel prays that the accused-applicant was arrested on 26.11.2024 and trial will take long time to conclude, therefore, the accused-applicant be enlarged on bail.
3. On the other hand, learned Public Prosecutor has opposed the bail application.
4. Heard learned counsel for the parties and also perused the material available on record.
5. Having regard to the facts and circumstances of the case; considering the fact that as per the charge-sheet submitted against the accused-applicant she has not been found involved in dacoity and the only evidence against the accused-applicant is that she sent the photographs of house of the complainant to co-accused-Aryan and also considering the fact no recovery has been made from the accused-applicant as well as considering the fact that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.
6. Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused- applicant Kumari Neelam @ Kanchan D/o Ashok, arrested in FIR No. 991/2024 registered at Police Station Kotwali Alwar,
