HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 35549 of 2025 Court No. - 6 HON'BLE DR. YOGENDRA KUMAR SRIVASTAVA, J. Heard Sri Shatrughan Yadav, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State respondents. The present petition has been filed seeking a direction to the respondent no.3, the Sub Divisional Magistrate Deoria, Tehsil Deoria, District Deoria, to ensure compliance of an order dated 3.7.2024 passed in a suit for division of holdings bearing Case No. 13502 of 2023 [Hasantara Devi and Others Vs. Bikau Singh and Others], under Section 116 of the U.P. Revenue Code, 2006. A representation, in this regard, is also stated to have been submitted before the concerned respondent. Counsel for the State respondents and the counsel for the respondent-Gram Sabha have raised an objection by pointing out that for the purpose of enforcement of an order passed in a suit for division of holdings the petitioner would have to invoke the appropriate statutory legal remedy, and the same cannot be done on the basis of a representation filed before the respondent authority on the administrative side. Counsel for the petitioner has not been able to dispute the aforesaid legal position. Accordingly, learned counsel states that he does not wish to press the petition and that the petitioner would avail the appropriate statutory legal remedy, in respect of his grievance. The petition stands disposed of accordingly. Office to return certified copy of the order to the counsel for the petitioner, after retaining photostat copy thereof. October 10, 2025 Arun K.
