HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 35383 of 2025 Court No. - 9 HON'BLE ARUN KUMAR, J. 1. Heard Shri Mohd. Shahanshah Khan, learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1, 2 & 3 and Shri Pradeep Singh, learned counsel for the respondent Gaon Sabha. 2. The present petition has been filed by the petitioner seeking a writ of mandamus directing respondent no.3 to make fresh allotment for vacant fair price shop in Gram Panchayat Rehi, Tehsil Ghorawal, District Sonbhadra. 3. Contention of the petitioner is that the licence of fair price shop in Gram Panchayat Rehi was cancelled and beneficiaries were attached to another fair price shop in Gram Panchayat Purna, which is three kilometer from the petitioner's village. 4. The arrangement made by the Sub Divisional Officer appears to be short term arrangement and merely on the difficulty faced by the petitioner, no direction can be issued to the State authorities to make fresh allotment in Gram Panchayat Rehi. However, learned counsel for the petitioner states that petitioner is not only facing the difficulty but other villagers are also raising same grievance. In view of the aforesaid, the petition appears to be more in the nature public interest, which is not maintainable. 5. In view of the above, the present petition is disposed of with liberty to the petitioner to file public interest litigation petition for redressal of his Versus Counsel for Petitioner(s) : Mohd. Shahanshah Khan Counsel for Respondent(s) : C.S.C., Pradeep Singh Nandlal S/O Surajman .....Petitioner(s) State Of U.P.
