Case of the prosecution, in brief, iS that, On 20.10.2024 at about 20.30 hours, the defacto complainant and his friend Devadari Bala Murali Krishna went to Appughar Beach. While they were talking With each other, four unknown persons came to them and demanded to give Rs.200/-, which was refused by them. Then,-the said Persons forcibly took Rs.320/-cash, watch and mobile Phone from his friend Bala Murali Krishna and beat them With hands. Heard learned counsel for the petI'tiOners and the learned AssI-Slant publl'c Prosecutor representing the respondenvstate. perused the material on record. 4. Learned counsel for the petitioners would subm,'t that by this time most of the l®nvestI-gatI'On mI-ght have been completed and the petl'tl®oners herel'n are innocent and the vI-Ctl'm suffered simple ,Injuries and section 309(6) of the BNS has no appll-catl'on of the facts of the case and further submit that the petjtjoners are ready to furnish sureties to the satisfaction of the court and hence, he prays to grant regular ba" to the petitioners hereI'n. 5. Moreover, the petI-tl'Oners herel'n € Q,',®ng 'xp^ >zj, Ei | Dr. VJP,.I Crl.P.No.2509 of 2025 have been in J-udiCial Custody Since 20.10.2024 and the investigation in the present crime is completed and the charge sheet is also filed in this matter and the question of tampering the evidence and influencing the witnesses does not arise. 7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners herein/Al to A4 on the following conditions. i) The petitioners herein/Al to A4 shall be released on bail on their executing a personal bond for Rs.20,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned Special Judge for Trial of Cases under SC & ST (PoA) Act-cum-XI Additional District Judge, Visakhapatnam. ii) The petitioners shall co-operate with the trial of the case. 8. Accordingly, the Criminal Petition is allowed. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
