Heard Mr. Kushmondeya Shahi, learned counsel for the petitioner, Ms. Usha Kiran, learned counsel for respondent nos.2 and 3 and learned standing counsel for the State-respondents. The writ petition has been filed with the following prayers:- "A. Issue a writ, order or direction in the nature of certiorari for quashing the order dated 12.09.2025 passed by respondent no.2 i.e. Superintending Engineer (Technical), 33/11 KV Fazalganj, Sub Station Kesco, District- Kanpur Nagar. B. Issue a writ, order or direction in the nature of mandamus directing the respondents to pay the differences of salary from April 2024 to August 2024 and the current salary as and when it falls due. C. Issue a writ order or direction which may be deemed fir and proper in the circumstances of the case." Learned counsel for the petitioner states and he is not pressing the prayer-B. Learned counsel for the petitioner is permitted to delete some part of the prayer from fifth line i.e. "and to direct ..................... to pass such other and." Learned counsel for the petitioner submits that petitioner has been placed under suspension by order dated 12.09.2025 on an allegation which, even if proved, does not warrant a major penalty. Therefore, the impugned order is in violation of Rule 4 of Uttar Pradesh Government Servant (Discipline and Appeal Rules) 1999. Learned counsel for respondent nos.2 and 3 could not dispute the aforesaid Versus Counsel for Petitioner(s) : Kushmondeya Shahi, Saurabh Chaturvedi Counsel for Respondent(s) : C.S.C., Usha Kiran Vijay Kumar Mehta .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) fact. In view of above, the impugned order dated 12.09.2025 shall be kept in abeyance. The writ petition is disposed of with a direction to the respondents to conclude the inquiry within a period of three months, from the date of production of certified copy of this order, and the petitioner is directed to co- operate in the inquiry.
