Applicant-Rinku, who is a charge sheeted accused, has approached this Court by means of present application under Section 528 BNSS with the following prayer:- "It is, therefore, Most Respectfully prayed that this Hon'ble Court may graciously be pleased to allow the present application and to quash the charge sheet no. 285/2023 dated 28.09.2023 in Case Crime No. 377/2023, U/s 376, 452 IPC and Sections 3/4 POCSO Act, P.S. Jait, District-Mathura (Annexure-7) to this affidavit. It is further prayed that if charge sheet is not quashed then this Hon'ble Court be pleased to released the applicant on bail till the final disposal of the charge sheet any other and further order may be passed which this Court deem fit and proper in the facts and circumstances of the case in favour of the applicant." 4. At the very outset, the learned counsel for applicant submits that in view of the subsequent developments, that have taken place, the applicant does not wish to press the present application inasmuch as, no cause of action survives with applicant to proceed further in this application. He, therefore, submits that this application be dismissed as withdrawn. 5. Learned A.G.A. representing State-opposite party-1 has no objection to the prayer made by the learned counsel for applicant. 6. In view of above, this application is, accordingly, dismissed as withdrawn. 7. Interim order, if any, stands vacated.
