HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22804 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. Heard Mr. Vikash Krishnamurti, learned counsel for the petitioners and Mr. Shashi Shekhar Tiwari, learned AGA appearing on behalf of the State. It is said that some proceedings were taken by the police in village Jagdishpur @ Lahuradeva, P.S. Kotwali Khalilabad, District Sant Kabir Nagar in the night intervening 07-08/09.2025. This led some 4 or 5 men from village Jagdishpur to visit Chowki Kante, where they engaged the informant Sub-Inspector, Chowki In-Charge Kante, Police Station Kotwali Khalilabad, complaining about the illegal proceedings taken by the police in their village. The informant was explaining that the police had not taken any proceedings in village Jagdishpura that night, but they would not relent. The informant assured the natives of the village that the proceedings in the village were not theirs. At this moment, a multitude of men and women alighted at Chowki Kante and shouted slogans against the police administration. Information in this regard was communicated to the S.H.O., Police Station Kotwali Khalilabad and Senior Police Officers over mobile phones. Additional force was summoned. Before the S.H.O., Police Station Kotwali Khalilabad could reach the spot, the crowd that had gathered there blocked the Gorakhpur National Highway on both sides. The police tried to clear the highway but members of the public would have nothing of it. After the S.H.O reached the spot with reinforcement, Versus Counsel for Petitioner(s) : Rakesh Kumar, Vikash Krishnamurti Counsel for Respondent(s) : G.A. Raghvendra Pratap Alias Raghvendra And 3 Other .....Petitioner(s) State Of U.P. And 3 Other .....Respondent(s) efforts were renewed to clear the highway. The members of the agitating unlawful assembly, who had gathered there, were uttering abusive words for the police and threatening them with death. Since both sides of the national highway had been blocked, ambulances carrying critical patients were held up as were school buses carrying children, who were crying and howling, agitated at the happenings around them. The public also misbehaved with drivers of smaller vehicles and motorcycles, which led to fear being struck in the locale. It is said in the FIR that the highway blocked by the public has been captured on videos. The police nominated some 36 men and women amongst the agitating members of the public besides another 50 to 60 unknown men and women. The petitioners are named in the FIR. Learned counsel for the petitioners argues that some of the petitioners are social workers and other daily wagers, who merely chanced upon the scene of occurrence and were falsely nominated. We are afraid that we cannot go into the case that the petitioners want us to examine in our jurisdiction under Article 226 of the Constitution. The allegations are very serious and one that affect law and order virtually bordering on public order. Holding up a highway is a very serious matter and this is a new found trend amongst members of the public to protest by throwing the even tempo of life out of gear and taking the law into their own hands. Whatever may be the outcome of investigation, we are of firm opinion that no interference is required by us so far as the impugned FIR against the petitioner goes. In the result, this writ petition is summarily dismissed. October 7, 2025 Subham CRLP No. 22804 of 2025 2 (Sanjiv Kumar,J.) (J.J. Munir,J.)
