This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/A1, seeking regular bail, in Crime No.92 of 2024 of S.Kota Police Station, Vizianagaram District, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c) of the NDPS, Act.

Brief facts of the case are that, on 06.04.2024, on receipt of credible information, the Sub Inspector of police along with his staff and mediators rushed to pandirappanna Juction, and caught the accused in possession of 200Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.
3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record.

Learned counsel for the petitioner would submit that no property has been seized from the possession of the petitioner herein/A1.
Learned counsel for the petitioner further would submit that petitioner is ready to furnish sureties to the satisfaction Court and hence, he prays to grant bail to the petitioner herein.
5. The petitioner herein was arrested on 10.10.2024 and since then he has been in judicial custody. The quantity of contraband involved in present crime is 200Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor submits that the case is still under investigation and some more witnesses are to be examined. In view of the aforesaid facts and circumstances of the case, petitioner does not deserve for grant of bail at this stage.
6. Accordingly, the Criminal Petition is dismissed.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
