Side) ********* O R D E R The petitioner, who was arrested on 05.08.2025 by the respondent police in connection with Crime No.257 of 2025, for offences punishable under Sections 8(c), 20(b)(ii)(B) and 29(1) of the NDPS Act, seeks bail. 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.25796 of 2025 2. The allegation against the petitioner is that he was found in possession of 10.628 kilograms of ganja. Hence, the present case. 3. The learned counsel appearing for the petitioner submitted that the petitioner was shown as arrested formally while he was already in prison. He further submitted that his implication as an accused is solely based on the confession of the arrested accused, and that the contraband involved is of intermediate quantity. Hence, he prayed for grant of bail. 4. Per contra, the learned Government Advocate (Crl. Side) submitted that the petitioner was arrested on the basis of the confession of the co-accused, and that it has been revealed that while in prison, he had handed over custody of the contraband to the arrested accused. He further submitted that the petitioner has 7 previous cases, out of which 6 relate to offences under the NDPS Act, including 2 cases involving commercial quantity. Hence, he opposed the grant of bail. 5. Heard the learned counsel on either side and perused the materials available on record. 6.
