GP FOR CIVIL SUPPLIES The Court made the following order: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not disposing of the appeal dated 28.10.2024 filed by the petitioner against the orders passed by the Joint Collector, Kadapa in Ref.No.1(4)/1065/2019, dated 17.03.2020 is illegal, arbitrary, violation of Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, violation of the order dated 30.09.2024 passed by the Hon’ble High Court in W.P.No.16191/2024 and violation of Article 21 of the Constitution of India and consequently restore the authorization of petitioner’s fair price shop and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.” 2 2. The petitioner is the fair price shop dealer of shop No.1112006, Shivaji Nagar, H/o.Madakalavaripalli Village, Gopavaram Mandal, Y.S.R. Kadapa District. Challenging the order of cancellation of the petitioner’s fair price shop authorization vide Ref.No.1(4)/1065/2019, dated 17.03.2020, the petitioner has filed W.P.No.16191 of 2024. The said writ petition was disposed of on 13.09.2024, directing the petitioner to approach the appellate authority within thirty days from the date of receipt of a copy of this order. Thereafter, the appeal shall be disposed of within two months upon presentation of the appeal filed by the petitioner. 3. The counsel for the petitioner submits that the petitioner has preferred an appeal before the District Collector on 28.10.2024, and even after the lapse of four months, the 2nd respondent has not passed any order till date. Aggrieved by this inaction, the petitioner has approached this Court. 4. Following the said direction and in terms thereof, the Writ Petition is disposed of directing the 2nd respondent to hold an enquiry on the appeal filed by the petitioner on 28.10.2024 by giving opportunity to the petitioner of being heard and pass a final order making an objective and rational approach expeditiously within a period of four weeks from the date of receipt of a copy of this order, failing which, the respondent authorities shall restore the authorization of the petitioner forthwith.
