Neutral Citation No. - 2025:AHC:103175-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 2038 of 2024 Petitioner :- Devanand Respondent :- State of U.P. and 5 others Counsel for Petitioner :- , Ashok Kumar Ram, Brahma Nand Pandey, Sudhir Kumar Singh Counsel for Respondent :- C.S.C., Rajiv Singh (S.C.) Hon'ble Arun Bhansali, Chief Justice Hon'ble Kshitij Shailendra, J.
1. This petition, purportedly in public interest, has been filed by the petitioner seeking direction to the respondents to conclude the enquiry initiated by order dated 23.04.2024.
2. Instructions have been produced inter alia indicating that pursuant to the order dated 23.04.2024, the enquiry has been concluded and an enquiry report dated 28.10.2024 has been submitted whereby the allegations made by the petitioner against respondent no.6 have been found to be baseless. Further indications have been made that petitioner had filed Writ-A No. 6063 of 2024 against respondent no.6 in the past, which has also been dismissed.
3. We have perused the enquiry report produced along with the instructions, wherein the Inquiry Officer has come to the conclusion that the allegations made in the complaint had no substance. Further, it is seen that petitioner apparently has some grudge against respondent no.6, inasmuch as Writ-A No. 6063 of 2024 was filed in the nature of quo warranto questioning the appointment of respondent no.6, which petition also came to be
rejected on 05.07.2024, whereafter the present petition has been filed.
4. Counsel for the petitioner attempted to make submissions that the enquiry has not been properly conducted and therefore, the same requires direction from this Court.
5. Filing of a PIL to the extent of ensuring that enquiry takes place, cannot be doubted. However, once an enquiry takes place and a report is submitted, seeking to question its validity and that also by a person who apparently has some personal scores to settle qua respondent no.6, cannot be countenanced.
6. The petition has no substance, the same is therefore, dismissed. Order Date :- 3.7.2025 AHA/Jyotsana (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- AFZAL HUSAIN ABBASI High Court of Judicature at Allahabad
