This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein, seeking regular bail, in Crime No.303 of 2024 of Nakkapalli Police Station, Anakapalli District, registered for the offences punishable under Sections 20(b)(ii)(C) read with 8(c), 25 of the NDPS, Act.

Brief facts of the case are that, on 19.10.2024, on receipt of credible information, the ASI along with his staff and mediators rushed to NH-16 road Kagitha Junction, towards Visakhapatnam to Tuni, and caught the accused in possession of 146Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report.
3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record.

Learned counsel for the petitioners would submit that basing on the confessional statement of A1 and A2, the names of the petitioners herein are arrayed as accused in the present crime. Learned counsel for the petitioners further would submit that petitioners are ready to furnish sureties to the satisfaction Court and hence, he prays to grant bail to the petitioners herein.
5. The petitioners herein were arrested on 22.10.2024 and since then they have been in judicial custody. The quantity of contraband involved in present crime is 146Kgs of Ganja, which is a commercial quantity. Learned Assistant Public Prosecutor submits that the case is still under investigation and some more witnesses are to be examined. In view of the aforesaid facts and circumstances of the case, petitioners do not deserve for grant of bail at this stage.
6. Accordingly, the Criminal Petition is dismissed.
As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed.
