Pathak, learned Standing Counsel for the State. 2. The instant petition has been filed for following reliefs:- "a. Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to decide the Second Appeal No. 1721 of 2021 (Ram Sakhi versus Commissioner Chitrakoot Dham Division, Banda and others) within short stipulated period pending in the Court of Hon'ble Board of Revenue U.P. at Allahabad. b. Issue any other suitable writ, order or direction, as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. c. Award cost of this petition in favour of the petitioner." 3. Learned counsel for the petitioner submitted that the second appeal arising out of partition suit filed at the instance of private respondent is pending before the respondent no. 2-Board of Revenue U.P., Prayagraj, since 09.12.2021. He further placed the order sheet of the pending proceeding in order to demonstrate that the matter is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, the instant petition is finally disposed of directing the respondent no. 2-Board of Revenue U.P., Prayagraj to decide the aforementioned second appeal, after affording proper Versus Counsel for Petitioner(s) : Manish Dwivedi Counsel for Respondent(s) : Achal Singh, C.S.C.
