Contd..2P.. THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2762 of 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The petitioner was arraigned as A.5 in Crime No.177 of 2024 of Rangampeta Police Station, East Godavari District, registered for the alleged offences under Sections 353(2), 352, 196 of the Bharatiya Nyaya Sanhita 2023. 3. The learned counsel for the petitioner submits that there are no specific allegations against the petitioner, and he was falsely implicated in the complaint. It is alleged in the complaint that the petitioner posted defamatory content on the social media platform, i.e., Facebook, against the political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Rangampeta Police Station, East Godavari District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for the -2- CRL.P. No.2762 of 2025 purpose of investigation in connection with Crime No.177 of 2024, insofar as the petitioner/A.5 is concerned. 5. Accordingly, the criminal petition is disposed off. 6.
