2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated for the offences under Sections 420, 120-B of IPC and Sections 66-C and 66-D of I.T. Act. It is contended that the main allegation is against the other co-accused Prem Prakash as the entire amount was transferred in the account of co-accused Prem Prakash. The accused-petitioner did not receive any amount in his account. The accused-petitioner is in custody since 11.10.2024, the trial of the case may take considerable time and the charge-sheet has already been
[2025:RJ-JP:13327] (2 of 2) [CRLMB-3477/2025] produced, therefore, the second bail application of the accused- petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the grant of second bail application and submitted the factual report, the same is taken on record.
4. Heard and perused the material available on the record.
5. In the factual report, it is specifically stated that the co- accused Prem Prakash has maintained the Account No.42681915760 and the entire amount allegedly received by deceiving the complainant was deposited in the said account maintained by co-accused Prem Prakash. The accused-petitioner did not receive any amount in his Bank Account, and further trial of the case may take considerable time, therefore, considering the above facts, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the second bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Naresh Kakad S/o Shri Rekharam, in connection with FIR No.11/2024, registered at Police Station Cyber Police Station (Alwar), District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
